General Terms and Conditions of "CLASH ROOMS FRANKFURT," powered by The Great Escape GmbH

for booking and conducting Clash Room / Bash Game activities and leisure events
 

1. Scope of the Terms and Conditions

1.1 These General Terms and Conditions (GTC) govern the business relationships between The Great Escape GmbH as the organizer and the customers who book a Clash Room game through Clash Rooms Frankfurt or other channels.

2. General Provisions for the Service

2.1 The Great Escape GmbH, hereinafter referred to as the organizer, operates Clash Room / Bash Game activities played in rooms, premises, indoor & outdoor areas, or room systems. The objective of the games is to solve the given tasks and challenges within a specific time limit. The maximum game duration is generally 150 minutes, including instructions/introduction, and can be shortened by the organizer at any time without providing reasons.

2.2 These terms and conditions apply to all civil law relationships associated with the Clash Room games.

2.3 By booking an appointment for a game with the organizer, purchasing a voucher, other items, or signing an agreement for a special event, the customer acknowledges these terms and conditions as legally binding within the contractual relationship.

2.4 Any terms contrary to or deviating from these GTC are hereby rejected unless the organizer explicitly agrees to them. Such agreement must generally be in writing. This also applies if, during the course of placing the order, the customer refers to their own GTC and the organizer provides services unconditionally.

3. Bookings and Data Protection

3.1 The booking of games preferably takes place via the organizer’s booking portal on www.clashrooms.de. The booking confirmation entitles the customer exclusively to attend the booked event at the specified time. Bookings can also be made verbally, by phone, via SMS, WhatsApp, post, email, or using the contact form on the operator’s website and become binding with the organizer's confirmation via SMS, post, or email.

3.2 Rescheduling is generally possible. A rescheduling request can be made considering the remaining time before the booked event. Cancellations or changes in participant numbers associated with a binding booking can be made up to 48 hours before the event for private customers and up to 7 days for corporate customers in writing. If the event has already started, the customer's right to the allocation of the booked Clash Room game lapses. The organizer reserves the right to claim damages from the customer up to the amount of the forfeited booking price for unutilized room rental, incurred personnel costs, and lost profits. Any such damage claims will be offset against the payments already made by the customer.

3.3 The organizer ensures that customers' or participants' data will not be shared with third parties without their written consent, except when necessary for the execution of the event and booking processing.

3.4 The organizer guarantees that customer data will be handled confidentially following data protection regulations.

3.5 At the end of a game, group photos are usually taken and may be posted on the Facebook fan page or the company’s online pages with the oral, written, or other consent of the customers. Customers may object to the taking or publication of photos at any time.

3.6 Any partially availed service, such as entering the Clash Rooms as per booking, will be charged according to the organizer's current price list. Games or services must generally be paid for in full by the customer before use unless agreed otherwise with the organizer in writing. Verbal agreements are not valid.

3.7 Services may be billed via invoice with the written consent of the organizer. If a service is billed via invoice (meaning the service is not paid on-site or before use), the total cost will include an additional processing fee of €50.00, including VAT.

4. Vouchers

4.1 Vouchers apply exclusively to the services listed on them and include statutory VAT.

4.2 Cash payouts for vouchers are excluded. This also applies to portions of the agreed service represented by a voucher, which cannot be paid out or credited against other services.

4.3 Vouchers issued by the organizer expire at the end of the third full calendar year following the issuance date. After this period, the customer has no legal claim to the service from the organizer.

4.4 Vouchers are non-transferable unless otherwise specified in writing on the voucher.

5. Game Procedure

5.1 For safety reasons, the events are designed so that customers are never actually prevented from leaving the room. Leaving the room generally results in the termination of the game unless it is necessary (e.g., unforeseen health issues of a participant, fire alarm, or similar events). Customers must follow the company’s personnel instructions for safety reasons.

5.2 The game room and publicly accessible areas may be monitored and recorded for security purposes. Security recordings are stored locally for a maximum of 20 days and then automatically overwritten. Customers have no claim to the release of these recordings, as they are company property and essential game mechanisms must remain confidential.

5.3 Participants must arrive on time at the agreed start time to receive instructions from the game master / Clash Master / coach.

5.4 In case of a delayed start caused by the customers, the game time will be shortened accordingly, provided a normal game process is still possible within the remaining time.

5.5 The organizer reserves the right to cancel the booked game in cases of unreasonable delays. In such cases, no refund of the costs will be provided.

6. Youth Protection, Suitability of Games

The organizer is responsible for compliance with the provisions of the Youth Protection Act (JuSchG) and reserves the right to verify the age of customers. The games are suitable for all visitors aged 14 and above who do not suffer from any illness or psychological impairment that could pose a risk to themselves or others during participation. Participants under 14 may only join the game when accompanied by an adult.

7. No Right of Withdrawal Under Distance Selling Law

The organizer offers services in the leisure event sector, including the option to book Clash Games online or by phone. According to § 312g Paragraph 2 No. 9 BGB, distance selling law does not apply. This means there is no right of withdrawal for booking agreements.

8. Liability of the Organizer, Compensation Obligation

8.1 The organizer is not liable for lost coats, valuables, or personal belongings. The organizer assumes no custodial responsibilities in this regard.

8.2 Customer claims for damages are excluded, except for claims arising from injury to life, body, or health or due to the violation of essential contractual obligations (cardinal obligations), as well as liability for other damages caused by willful or grossly negligent breaches of duty by the organizer, its legal representatives, or vicarious agents. Essential contractual obligations are those necessary for achieving the contract's purpose.

8.3 Compensation claims are excluded unless they are based on intent or gross negligence by the organizer or its vicarious agents.

9. Participant Behavior Rules

9.1 All events held in the rooms (or at locations mentioned in Section 2.1) and the furnishings of the rooms are protected works under § 2 of the Copyright Act. Photography and the making of video or audio recordings are strictly prohibited unless explicitly authorized in writing by the organizer. The organizer reserves the right to pursue civil claims and file criminal charges in the event of unauthorized recordings.

9.2 Bringing and consuming food or drinks in the event area is generally prohibited unless expressly permitted by the organizer.

9.3 Smoking is strictly prohibited in all event areas.

9.4 The organizer may deny access to the event area if there is reason to believe a customer’s behavior (e.g., due to alcohol or drug consumption) could disrupt the event or disturb other visitors.

9.5 Permission to bring animals into the venue must be obtained in advance, either verbally or in writing, from the organizer.

9.6 Customers are responsible for carefully handling furniture and equipment in the game rooms during their stay. The organizer reserves the right to pursue civil claims and file criminal charges in cases of grossly negligent or intentional damage.

9.7 The use of mobile phones in the game rooms is prohibited.

9.8 The organizer’s staff exercises house rules during the events. Customers must follow staff instructions.

10. Consumer Dispute Resolution

The Great Escape GmbH is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

11. Severability Clause

If individual provisions of these GTC are or become invalid, the validity of the remaining provisions shall remain unaffected. An admissible provision that most closely approximates the invalid provision shall replace it.
